3. Our products
Divert Collective sells digital products, including downloadable guides in PDF format and associated digital materials (Products). Products are delivered electronically. Nothing physical is shipped. The products in question were created with the assistance of AI platforms.
Product descriptions, inclusions and prices are set out on the relevant sales page at the time of purchase. We take care to describe our Products accurately, but minor variations in formatting or presentation may occur across devices.
You are responsible for ensuring you have the device, software and internet access required to access and use the Products. We do not guarantee that Products will be compatible with every device, operating system or application.
4. Pricing and payment
All prices are listed in Australian dollars (AUD) unless otherwise stated.
We are not currently registered for GST. Prices do not include GST.
If you are purchasing from outside Australia, your bank or card issuer may apply currency conversion and international transaction fees. These are set by your provider, not by us. Prices shown do not include VAT, sales tax or similar consumption taxes. Where such taxes are legally payable by us as the seller (for example, VAT on sales to United Kingdom or European Union consumers), meeting that obligation is our responsibility, not yours, and any such taxes owed on your purchase are accounted for and remitted by us. We are not yet registered for VAT in these regions and do not currently collect it at checkout; we register and begin collecting VAT once registration is required.
Payment is processed securely by SamCart using SamPay (payment processing powered by Stripe). We do not see, store or handle your full card details at any time. Your payment information is handled in accordance with the payment processor's own terms and privacy policies.
We reserve the right to change our prices at any time. Price changes do not affect purchases already completed.
5. Delivery of digital products
Products are delivered by download link and/or email immediately or shortly after successful payment. It is your responsibility to provide an accurate email address at checkout.
If you do not receive your Product within 24 hours of purchase, check your spam or junk folder first, then contact us at hello@divertcollective.com and we will re-send it.
Once delivered, you are responsible for downloading and safely storing your Product. We will make reasonable efforts to assist with access issues, but we do not guarantee that download links or access to Products will remain available indefinitely.
Consent to immediate delivery: By completing your purchase, you request immediate delivery of the digital Product and acknowledge that, where your local law provides a cooling-off or withdrawal period for digital content (for example, in the European Union or the United Kingdom), that right ends once delivery of the digital content has begun. This does not affect any rights that cannot lawfully be excluded, including your rights under the Australian Consumer Law described in section 7.
6. Refunds
We want you to be happy with your purchase. If a Product is not right for you, you may request a refund within 14 days of purchase by emailing hello@divertcollective.com from the email address used at checkout, with your order details. Approved refunds are returned to your original payment method. Refund requests made more than 14 days after purchase are at our discretion.
We reserve the right to refuse a refund where we reasonably believe the policy is being abused, for example repeated purchase-and-refund behaviour across multiple Products. Refund requests must include enough information for us to verify the purchase and assess the request.
This policy is offered in addition to, and does not exclude, restrict or modify, any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. See section 7.
If something has gone wrong with your purchase, such as a faulty file, a Product that is materially different from its description, or a failed delivery, contact us at hello@divertcollective.com at any time and we will make it right, including by replacement or refund where required, regardless of the 14-day window above.
7. Australian Consumer Law
Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to a refund or replacement and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Product remedied if it fails to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
If you are a consumer in another jurisdiction, you may have additional rights under your local consumer protection laws. Nothing in these terms is intended to exclude rights that cannot lawfully be excluded in your jurisdiction.
8. Licence and permitted use
When you purchase a Product, we grant you a personal, non-exclusive, non-transferable licence to download and use the Product for your own personal use.
You must not:
All intellectual property in the Products and this website, including text, design, structure, frameworks and branding, is owned by or licensed to us and is protected by Australian and international copyright law. Purchasing a Product transfers no ownership of any intellectual property to you.
We may terminate this licence if you breach these terms. If your licence is terminated, you must stop using the Product and delete any copies in your possession, except where retention is required by law.
9. No professional advice
Our Products and website content are general information and self-guided educational material only. They are not medical, psychological, therapeutic, financial or legal advice, and they are not a substitute for professional support tailored to your circumstances.
If you are experiencing significant distress or mental health difficulties, please seek support from a qualified professional or a crisis service in your country.
You are responsible for how you apply the material in our Products to your own life and circumstances. We do not guarantee any specific results, outcomes or improvements from using our Products; results vary depending on individual circumstances and how the material is applied.

13. Governing law and disputes
These terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of Western Australia.
If you are a consumer in another country, this clause does not deprive you of the protection of any mandatory consumer protection laws of your country of residence.

14. General
If any part of these terms is found to be invalid or unenforceable, the remainder continues in full effect. A failure by us to enforce any right under these terms is not a waiver of that right. These terms, together with the Privacy Policy and the terms presented at checkout, are the entire agreement between you and us in relation to your use of this website and your purchases. These terms may be supplemented by additional terms presented at checkout or relating to specific Products; if there is any inconsistency, the specific terms presented at the time of purchase apply to that purchase.
